2. STANDARD TERMS OF PURCHASE

These Terms of Purchase form part of the Seller’s obligations under the Consumer Protection Act and are intended to ensure that the Buyer is clearly and comprehensibly informed of the circumstances relevant to the conclusion, performance and termination of a distance contract, in accordance with legal provisions.

“Buyer” means an ordinary consumer — a natural person ordering and paying for a product via the web shop on the Seller’s website outside any business activity — as well as sole traders and natural persons engaged in business activities (protected by the Consumer Protection Act only where they buy products unrelated to their business), and all other buyers, including legal persons.

By selling via https://travelexperiencemuseum.com, the Company acts in its own name. The Terms of Purchase form part of the distance contract together with the specifications and prices of the purchased product. Before confirming an order, the Buyer will be asked to accept these terms or declare awareness of and agreement with them. After order confirmation, the terms are sent to the Buyer within the e-mail confirming conclusion of the contract. The Seller reserves the right to amend the terms, which take effect upon publication on the website.

3. PRE-PURCHASE INFORMATION

These Terms of Purchase set the general conditions for distance purchases — via https://travelexperiencemuseum.com – of documents valid for entry (“Tickets”) to the TEM museum, as well as additional services, including the service of obtaining digital photographs and videos depicting the buyer among the museum exhibits and premises.

The User may review the various types of Tickets available for online purchase. Tickets purchased online are valid indefinitely and may be used at any time during the museum’s opening hours.

Prices are stated in euros, with a breakdown of all applied discounts/promotions, fees and additional costs. Browsing information on the website is free of charge.

By purchasing any Ticket or service, the User confirms having carefully read the Terms of Purchase and any applicable Special Terms of Purchase, and accepts their content in full. The User’s rights and obligations are subject to these Terms, the applicable Special Terms and the TEM General Rules.

The User declares having the capacity to be bound by these Terms. Purchases of Tickets or other services, whether for personal use or for third parties, are made under the User’s responsibility.

Upon finalisation of the purchase, a distance contract is concluded between the Company TRAVEL EXPERIENCE d.o.o. (the “Seller”), with its seat at Mate Vlašića 20, 52440 Poreč-Parenzo, OIB 03857142786, tel. +385 91 639 29 76, +385 91 639 29 75, e-mail info@travelexperiencemuseum.com, and the User.

By publishing these general terms of sale, the Company fulfils its duty to inform consumers. The Terms regulate solely the Company’s products and services; liability for third-party products and services accessible via links or banners is excluded.

3.1 Publication of online reviews

Reviews published on the Company’s websites come from customers who actually purchased TEM tickets and relate to genuine experiences, as well as from reviews on third-party sites (e.g. Tripadvisor, Google).

3.2 Purchase process

To purchase, the User follows the instructions in the “KUPI ULAZNICE” (Buy tickets) section and provides the requested information. Before submitting the order, the User expressly ticks the relevant box as a sign of understanding and acceptance of the Terms of Purchase and any special terms.

Free entry is granted to children under 5 years of age and to persons with disabilities upon presentation of a valid disability card.

3.3 Registration and user account

To complete a purchase, the User creates an account and provides personal data (mandatory fields are marked in the form). We process the data in order to: (i) enable the account and the purchase of TEM tickets/services; (ii) verify the profile upon changes to the data; (iii) send communications relating to events for which you purchased tickets/services. Processing is based on Art. 6(1)(b) and (f) GDPR (performance of a contract and legitimate interest).

Upon completing registration, the User receives an OTP code by SMS; purchase confirmation requires OTP authentication. The login and password are personal and must not be transferred to third parties; the User is responsible for all operations, must keep the data confidential and must immediately notify the Company of any unauthorised use. The OTP is a one-time password of limited duration (generally expiring after 30 seconds).

3.4 Legal documentation and language

The Terms of Purchase are available in the “KUPI ULAZNICE” (Buy tickets) section; you may print and keep a copy. After completing the purchase, the website redirects to a summary confirming the purchase; errors in mandatory fields are reported automatically. A correct purchase is confirmed by e-mail containing the ticket (unique code), price and payment method. The Ticket is presented in paper or digital format at the entrance; damaged or tampered tickets are voided.

If the User does not receive the confirmation e-mail, they should contact Customer Service at +385 91 639 29 76, +385 91 639 29 75 or info@travelexperiencemuseum.com. The Ticket constitutes a document with fiscal validity. After a Ticket is issued, no changes or refunds are permitted except in the circumstances set out in article 3.9 and/or applicable law (contact: +385 91 639 29 76, +385 91 639 29 75 / info@travelexperiencemuseum.com). If payment authorisation is declined, the Company cannot send the tickets and is not liable for delays. The Terms are drawn up in Croatian and English; the purchase process is completed in the language chosen by the User.

3.5 Entry to TEM

The Ticket is presented at the entrance (paper or digital); damaged/tampered tickets are voided. Tickets purchased online are valid indefinitely and may be used at any time during the museum’s opening hours. A ticket purchased online is personal and bears the buyer’s name, but entry is regularly permitted also to holders whose name does not match the one printed; on request, staff may ask for photo ID.

The Ticket grants access to all available attractions and shows, except for attractions, shows or services expressly marked at the time of purchase as subject to an additional charge or excluded. The Ticket does not include products in the souvenir shops. Bringing food and drink into the museum premises is not permitted. Tickets cannot be duplicated; copies of already-validated tickets will not be accepted.

3.6 Technical means

The website notifies of any errors when entering data into the forms during the purchase.

3.7 Amendment of the Terms of Purchase

The Terms take effect on the date of their latest amendment (stated at the end). The Company reserves the right to amend the terms for technical and organisational reasons; amendments take effect upon publication and apply to Users accessing the site thereafter. For a given purchase, the terms in force at the time of that purchase apply.

3.8 Exclusion of the right of withdrawal. Changes and refunds

Unless the Special Terms provide otherwise, no exchanges, changes or refunds are allowed for tickets, products or services. By purchasing, the User accepts that, due to the specific characteristics of the Ticket or service, there is no right of withdrawal (“cooling-off period”).

3.9 Price and payment methods

The price is shown before purchase and includes all taxes. Supported payment methods: credit card, PayPal and KEKS Pay.
The Company warrants that it has taken appropriate measures meeting current security standards, such as SSL/TLS security protocols. Access to transactional services and services involving the collection of personal data takes place in a secure environment using the SSL (Secure Socket Layer) protocol with 128-bit encryption; data are transmitted encrypted. Users can recognise the secure environment by the padlock icon in the browser. Server security is guaranteed by a certificate issued by an authorised certification authority (Sectigo). As part of fraud prevention, the Company cooperates with payment platforms and competent authorities, in accordance with the law.

3.10 Incorporation of Special Terms and House Rules

By purchasing, you accept the Terms of Purchase, the applicable Special Terms and TEM’s General Rules and Regulations, available on the TEM website. Please read them carefully before purchasing.

3.11 Privacy

The Company processes the User’s data in accordance with applicable data protection law and the Privacy Policy available at https://travelexperiencemuseum.com/en/privacy-policy (HR: /politika-privatnosti). For any questions about processing and to exercise your rights, contact the Data Protection Officer (DPO) at gdpr@travelexperiencemuseum.com.

3.12 Intellectual property rights

The trademarks, logos and content of the website https://travelexperiencemuseum.com are the exclusive property of the Company and may not be reproduced without prior written permission.

4. INFORMATION AND COMPLAINTS

Any enquiries or complaints relating to your purchase may be addressed to Customer Service: +385 91 639 29 76, +385 91 639 29 75 or info@travelexperiencemuseum.com. Your request will be handled internally as soon as possible.

5. APPLICABLE LAW, JURISDICTION AND ALTERNATIVE DISPUTE RESOLUTION

These Terms are governed by Croatian law. A dispute is subject to the jurisdiction of the court of the User’s place of residence. A User resident in another EU Member State may use the European small-claims procedure (Regulation (EC) No 861/2007) where the value of the dispute does not exceed EUR 2,000.00. The User may also bring the dispute before a competent court and, where applicable, initiate out-of-court resolution of consumer disputes. Disputes relating to online purchases within the EU may be resolved via the European Commission’s Online Dispute Resolution (ODR) platform.

SPECIAL TERMS RELATING TO CERTAIN PRODUCTS

6. Special terms for tickets purchased online (open date)

The Ticket grants access to TEM during the museum’s opening hours. Do not tear, alter or photocopy the Ticket — otherwise entry may be refused. Access is granted by presenting the printed or digital Ticket. In the event of a purchase error (wrong ticket type), the difference may be arranged and/or paid directly at the Company’s office at the TEM entrance. The Ticket is valid indefinitely and may be used during the opening hours published on the TEM website; the User must check the opening hours.

Each ticket has a unique QR code granting ONLY ONE ENTRY. Same-day exit and re-entry are permitted with the appropriate stamp from entrance staff. For tickets under special conditions (persons over 65 or pensioners, persons with disabilities; children’s discount), proof of eligibility (ID etc.) may be requested at the entrance. Once validated, a ticket is non-refundable. Resale of tickets to third parties is prohibited.

Due to maintenance, power outages or adverse weather, certain attractions may be unavailable for safety reasons; in such cases no refund, even partial, is provided. TEM may be closed for safety or public-health reasons; in that case the Company will inform Users via the website and social media and propose a new date or another solution.
